These Terms and Conditions apply to all purchases made from SMSCS Games ApS, unless otherwise agreed in writing.

2. Products

On the website www.muswicbingo.online SMSCS Games ApS exclusively sells digital products delivered electronically. Products may consist of downloads, access to online content, or other forms of digital delivery.

3. Ordering and Payment

When placing an order, a binding agreement is entered into between the customer and SMSCS Games ApS.

All prices are stated in EUR, inclusive of VAT, unless otherwise specified.

Payment can be made using the available payment methods shown at checkout. The amount will be charged upon completion of the order, after which the digital product will be made available to the customer.

4. Delivery

Digital products are delivered immediately after successful payment. Delivery is considered complete once access to the product has been granted — for example, via download link, login, or online access.

5. Right of Withdrawal

In accordance with  Article 16(m) of Directive 2011/83/EU on Consumer Rights, the right of withdrawal does not apply to digital content that is not supplied on a physical medium once performance has begun with the consumer’s prior express consent and acknowledgement of the loss of the right of withdrawal.

By completing the purchase, the customer expressly consents to the immediate supply of the digital content and acknowledges that the right of withdrawal is thereby forfeited.

Consequently, no cancellations, returns or refunds can be made once the digital product has been delivered.

6. Defects and Complaints

The provisions of the Danish Sale of Goods Act (Købeloven) apply to any defects in the delivered product.

If the digital product is defective or not supplied as agreed, the customer must notify SMSCS Games ApS within a reasonable time after discovering the defect. SMSCS Games ApS will remedy the issue in accordance with applicable law.

7. Limitation of Liability

SMSCS Games ApS is liable in accordance with the general rules of Danish law. However, the company cannot be held liable for indirect losses, consequential damages, loss of profit, or other economic consequential loss. Liability is limited to the amount paid by the customer for the product in question.

8. Personal Data

Personal data are processed in accordance with the EU General Data Protection Regulation (Regulation (EU) 2016/679 – GDPR) and the Danish Data Protection Act.

9. Governing Law and Jurisdiction

All agreements are governed by Danish law. Any disputes that cannot be resolved amicably shall be brought before the Danish courts, with Lyngby Court (Retten i Lyngby) as the agreed venue.

10. Copyright and License

All digital products, including game materials, graphics, text, audio files, and other content provided by SMSCS Games ApS, are protected by copyright law and are the property of SMSCS Games ApS.

By purchasing a product, the customer is granted a non-exclusive, non-transferable license to use the product for personal or internal purposes in accordance with its intended use.
The product may not be copied, redistributed, modified, published, resold, or otherwise exploited for commercial purposes without prior written consent from SMSCS Games ApS.

Any infringement of copyright may result in a claim for damages and legal action in accordance with applicable law.
